Welcome to BodyMax.fit. These Terms of Service ("Terms") govern your access to and use of our AI-powered fitness coaching platform, website, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree with any part of these Terms, you may not use our Service.
BodyMax.fit provides fitness coaching and guidance only. Our Service is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any exercise program, especially if you have pre-existing health conditions, injuries, or concerns. If you experience pain, dizziness, or other symptoms during exercise, stop immediately and seek medical attention.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to update this information as needed.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at security@bodymax.fit if you suspect unauthorized access.
You may delete your account at any time through Settings. We may suspend or terminate accounts that violate these Terms, with or without notice.
BodyMax.fit is currently in a prelaunch phase. All new users receive:
No payment information is collected during the prelaunch phase. There are no automatic charges or recurring billing.
We may introduce paid subscription plans in the future. If and when paid plans become available, we will notify you in advance and clearly present pricing, billing terms, and cancellation options before any payment is required. You will never be charged without explicit consent.

Our AI coaches provide fitness guidance based on the information you provide. While we strive for accuracy, AI-generated workout plans and advice are provided "as is" and may not be suitable for all individuals.
AI coaches are designed for fitness topics only. They cannot provide medical advice, psychological counseling, legal advice, or other professional services. Always consult appropriate professionals for such needs.
You are responsible for evaluating the suitability of any workout or advice for your personal situation. If an exercise causes pain or discomfort, stop immediately and inform your coach.
The Service, including its design, features, content, and underlying technology, is owned by BodyMax.fit and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
You retain ownership of content you submit (e.g., feedback, messages). By submitting content, you grant us a non-exclusive, royalty-free license to use, display, and process it for providing the Service.
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
FITNESS RESULTS VARY BY INDIVIDUAL. WE DO NOT GUARANTEE ANY SPECIFIC OUTCOMES FROM USING THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BODYMAX.FIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless BodyMax.fit and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
Before filing any formal dispute, you agree to contact us at legal@bodymax.fit and attempt to resolve the matter informally within 30 days.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits are waived to the extent permitted by law.
We may modify these Terms at any time. Material changes will be communicated via email or prominent notice in the app at least 30 days before taking effect. Your continued use after changes indicates acceptance of the updated Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BodyMax.fit regarding the Service and supersede all prior agreements.
